The last few days

I’ve been keeping pretty busy the last few days. We went paintballing on Thursday, Friday, and Saturday up at our cabin in Estes. On Sunday, I had that problem with BestBuy. Monday I argued with BestBuy Custumer unSupport for at least 30 minutes. Then I went to the bank to deposit some money and change my address. However, the WaMu banking system is divided into three networks: West, Central, and East. My bank account is in the Western network while Colorado is in the Central network. Thus, I couldn’t do my banking here. This was going to be a problem. So I decided just to open a new bank account here. Anyways. I went to Mines to get my EKey so I can log into the network and get access to all sorts of cool stuff. I even have a new email address:

I also managed to obtain my Colorado’s drivers license from the DOL. I’m now also a registered voter in the State of Colorado. Getting my license and even the bank account are the part of the first steps to establish residency. Establishing residency in Colorado is somewhat arduous task. The CRS (Colorado Revised Statue) has an entire section on it (see below). Anyways, there are some big personal and legal questions involved…something that will take lots of time.

Continuing on with my week in review. On Tuesday we went to Water World. I managed to get a little red. Yesterday and today we just hung out. It was nice.

23-7-103. Presumptions and rules for determination of status.

Statute text

(1) Unless the contrary appears to the satisfaction of the registering authority of the institution at which a student is registering, it shall be presumed that:

(a) The domicile of an unemancipated minor is that of the parent with whom he or she resides or, if there is a guardian of his or her person, that of such guardian, but only if the court appointing such guardian (who has legal custody of the minor child as defined in section 19-1-103 (73), C.R.S.) certifies that the primary purpose of such appointment is not to qualify such unemancipated minor as a resident of this state and that his or her parents, if living, do not provide substantial support to the minor child;

(b) Repealed.

(c) (I) A person does not gain or lose in-state status by reason of his presence in any state or country while a member of the armed forces of the United States; but a member of the armed forces may be eligible to obtain in-state status for himself after being domiciled in Colorado for twelve continuous months and complying with the provisions of this article or, notwithstanding the length of his residency, upon moving to Colorado on a permanent change-of-station basis; except that such in-state status shall not be considered in determining limitations on maximum enrollment placed on institutions of higher education in Colorado and such in-state status shall not apply to members of the armed forces of the United States who attend education programs on military bases and such in-state status shall also be subject to the limitations in subparagraph (II) of this paragraph (c). A member of the armed forces may also apply for in-state tuition classification for his or her dependent upon meeting the requirements of this section.

(II) The governing board of each institution of higher education may grant in-state tuition status to members of the armed forces or their dependents pursuant to the criteria set forth in subparagraph (I) of this paragraph (c); except that, for the purposes of calculating general fund support of said institution in the general appropriation act for the 1986-87 school year, such persons shall not be counted as resident students.

(III) Repealed.

(d) The establishment of a new domicile in Colorado by a qualified person formerly domiciled in another state has occurred if he is physically present in Colorado without a present intention to return to such other state or to acquire a domicile at some other place outside of Colorado;

(e) Once established, a domicile has not been lost by mere absence unaccompanied by intention to establish a new domicile;

(f) The establishment of a Colorado domicile for twelve continuous months in accordance with the provisions of this article by the parent of a parent-qualified student entitles the student to in-state tuition rates;

(g) A minor is unemancipated.

(2) To aid the institutions in deciding whether a student, a parent or guardian of the student, or the person who provides substantial support to the student is domiciled in Colorado, the following rules shall be applied:

(a) Payment of Colorado income tax is highly persuasive evidence of domicile in Colorado. If spouses file income tax returns in different states, the income tax paid to each state may be considered in determining whether domicile in Colorado is proper.

(b) Nonpayment of Colorado income tax by a person whose income is sufficient to be taxed is highly persuasive evidence of non-Colorado domicile.

(c) After a student has registered at an institution, his classification for tuition purposes remains unchanged in the absence of clear and convincing evidence to the contrary. Such evidence shall be reduced to writing and filed with the registering authority of the college. Changes in classification established by such evidence, whether from out-of-state to in-state or the reverse, shall be in writing, signed by the registering authority of the college, and given effect at the time of the student’s next registration.

(d) A qualified person cannot establish a new domicile in Colorado if he lacks the intention of so doing.

(e) No person may establish a domicile in Colorado solely for the purpose of changing a student’s classification for tuition purposes from out-of-state to in-state. Any student who is classified for tuition purposes as an out-of-state student at the time of registration at an institution and who personally or through his parent, his guardian, or the person who provides substantial support to him seeks to establish Colorado domicile while registered shall be presumed to seek to establish Colorado domicile solely for tuition purposes in the absence of clear and convincing evidence to the contrary.

(f) The following may be considered evidence of domicile even though no one of these criteria, if taken alone, may be considered as conclusive evidence of domicile:

(I) Employment in Colorado, other than that normally provided on a temporary basis to students by an institution of higher education or other temporary employment;

(II) Ownership of residential real property in Colorado;

(III) Graduation from a high school located in Colorado;

(IV) Continued residence in the state of Colorado during periods when not enrolled as a student or during periods between academic sessions;

(V) Acceptance of future employment in the state of Colorado;

(VI) Vehicle registration in Colorado;

(VII) Any other factor peculiar to the individual which tends to establish the necessary intent to make Colorado a permanent home;

(VIII) Voter registration in Colorado.

(g) The following may be considered as evidence of domicile in another state even though no one of these criteria, if taken alone, may be considered as conclusive evidence of domicile in another state:

(I) Failure to comply with any law imposing a mandatory duty upon a domiciliary or resident of this state;

(II) Maintenance of a home in another state;

(III) Prolonged absence from Colorado, except in military or governmental service or except when the absence is due to a temporary relocation required as a condition of employment which the employer does not intend to make permanent or except when the student has been out of state for less than three years and such student’s parent or legal guardian was and continues to be a resident of Colorado;

(IV) Return to one’s former residence for a substantial portion of the time during periods when not enrolled as a student or between academic sessions;

(V) Vehicle registration in another state;

(VI) Any other factor peculiar to the individual which tends to establish the fact that his permanent home is in another state.

(h) The following may be considered as evidence of emancipation for the purposes of this article even though no one of these criteria, if taken alone, may be considered as conclusive evidence of emancipation:

(I) An affidavit of the parents stating their relinquishment of any claim or right to the care, custody, and earnings of the minor as well as the duty to support the minor;

(II) Entry into the military service by the minor;

(III) Failure of the parents to provide financial support to the minor, coupled with the evidence that the minor is independently able to meet his own financial obligations, including the costs of his education;

(IV) Any other factor peculiar to the individual which tends to establish that he is independent of his parents and is providing his own support.

(i) The following may be considered as evidence of nonemancipation for the purpose of this article even though no one of these criteria, if taken alone, may be considered as conclusive evidence of nonemancipation:

(I) The claiming of a minor as a dependent for the purposes of income taxation;

(II) Receipt of gifts, loans, or trust proceeds from an inter vivos trust by a minor regardless of the date of receipt thereof which the minor depends upon for financial support, whether the gifts, loans, or trusts from which proceeds are paid are made by the parents, any other relative, or a friend of the minor;

(III) Residence in the home of his parents by the minor, except for temporary visits;

(IV) Any other factor peculiar to the individual which tends to establish that he lacks independence and is dependent upon his parents.

(j) The marriage of a minor results in his emancipation.

(k) The establishment of a Colorado domicile shall be the burden of the person seeking to establish domicile. The registering authority of any state institution of higher education shall require the individual seeking to establish domicile to support his claim by clear and convincing evidence of the validity of the claim. The registering authority may require the individual seeking to establish domicile to complete forms prepared by the Colorado commission on higher education for the purpose of aiding him in his determination and to provide such documentation as may be required to support the classification.

(l) Only a qualified person can establish a domicile.

(m) (I) Any person who himself or, if an unemancipated minor, through his parent or legal guardian has had an established domicile in this state for not less than one year shall not be considered to have lost such domicile for tuition purposes unless such person would be classified as an in-state student for tuition purposes in another state if the rules and presumptions in this section for classification as an in-state student were applied in such other state to such person.

(II) Any unemancipated minor whose parent or legal guardian was domiciled in Colorado for at least the four immediately preceding years and whose parent or legal guardian moves from this state shall be classified as an in-state student if:

(A) The parent or legal guardian leaves the state after the minor completes his or her junior year of high school and the minor matriculates at a Colorado institution within three years and six months after the time the parent or legal guardian leaves the state; or

(B) Notwithstanding his or her unemancipated status, the minor maintains continuous Colorado domicile subject to all other provisions of this section.

(n) Participation in an education expense program shall not be considered evidence of domicile in this state or in another state.

(o) A foreign national, notwithstanding an intention to return to his or her country of origin or ineligibility to establish domicile in the United States pursuant to federal law, shall be eligible for classification as an in-state student subject to all other provisions of this section if the primary purpose of the foreign national’s residence in Colorado, pursuant to federal immigration regulations, is other than for his or her education or for the education of a family member. The Colorado commission on higher education shall designate those nonimmigrant classifications under which such foreign nationals may qualify as in-state students. In no event shall said designation displace students who would otherwise qualify as Colorado residents for in-state tuition classification purposes.

(2.5) Repealed.

(3) An unemancipated minor qualifies for a change in his or her classification to in-state student for tuition purposes only if either of his or her parents, regardless of custody or parental responsibilities, or his or her legal guardian has completed the requirements for establishing a Colorado domicile. Eligibility for classification as an in-state student for tuition purposes shall be lost if both of his parents, regardless of custody or parental responsibilities, or his or her legal guardian has lost eligibility. An emancipated minor or adult who has registered as a student does not qualify for a change in his or her classification to in-state student for tuition purposes unless he or she has established and maintained a domicile for twelve continuous months in this state.

(4) Repealed.

(5) The presumptions and rules in this section shall determine tuition classification except when exceptions are made by the general assembly in other sections of this article.

To Whom It May Concern:

I recently had a rather unusual and disturbing experience at the Best Buy located at 635 Flatiron Marketplace Drive, Broomfield, Colorado today, July 25th, 2004. My experience begins on June 11th in Seattle where I purchased a 3rd Generation 20GB Apple iPod for $399 plus tax. A few weeks after that, I purchased a Service Plan for my newly acquired iPod.

About a week ago, I saw a news report that said that Apple had released their 4th Generation iPods. I was somewhat miffed by this because I had just purchased my iPod less then a month and a half ago and now there is a new iPod that not only has more features, including better lifespan, but is also one-hundred dollars cheaper. A few days later, July 22nd, I decided to call the aforementioned Best Buy location to see what my options where. I ended up speaking to a lady in customer service whose name I failed to write down. I first asked her if they had the new iPods in stock. She said that they did not have them quite yet. Then I told her how I purchased an iPod about a month and a half ago and that the new iPods had just come out and I was wondering what I could do. She asked me if I had a service plan and I said I did. Then she told me that I could bring my iPod in and exchange it for the new one. I asked her if my service plan would transfer over. She asked me how long it was for. I responded that it was a 4 year plan. She then said that I would 3 years and ten and a half months left on for the new iPod.

That brings me to yesterday. I spend a good deal of time transfer all my music from my iPod back onto my computer so that I would not lose it. I then proceeded to the aforementioned Best Buy location and promptly went to the Returns/Exchange desk. I told them that I had talked to someone in Customer Service who said that I could exchange my iPod. They then told me to go wait by the MP3 Section. I waited for a few minutes and then a woman, who I later found out to be the manager of the store, came out and told me that I could not exchange my iPod, despite what I was promised over the phone not even a week prior. I explained my situation, relating exactly what I have told you above. We bickered for a few minutes and then talked with the repair person to see what the requirements where to get the new 4th Generation iPod. I then asked to speak to the manager. She informed me that she was the manager. I asked if there was a regional rep I could speak with and she referred me to 1-888-BEST-BUY. Being a Sunday, your office was closed. I elected to write this letter instead and then to call 1-888-BEST-BUY first thing today.

When I called the 1-888-BEST-BUY, I was given a load of crap. I talked with four different people: Eva, Liji, Brian, and Brandon. Every person I talked to assured me that nothing could be done, despite the fact that a Best Buy employee told me otherwise. They then said that I would have to talk with the store manager, even though the store manager referred me to 1-888-BEST-BUY. To top it all off, Brandon, the last person I spoke with, hung up on me.

All I wanted to was to exchange my iPod. All I got was a bunch of “No, we can�t do that even though someone else in company said yes.” To me, this is two things, plain and simple: 1) Bad business; 2) False advertising. Granted, you didn�t actually take out an ad in the newspaper and declare that users of 3rd Generation iPod�s with Service Plans could exchange them for 4th Generation iPods, however, I was assured by one of your Customer Service Representatives that I could in fact exchange my iPod. When I take my time to copy the music back to my computer and then take my time to drive over to Best Buy using my gas, only to find out that you now want to back out of your original promise, I find that incredibly disturbing, alarming, upsetting, and distressing. Now I�ve taken the time to write you this letter and I will take the time tomorrow to speak with you over the phone. Never again will I place so much trust in your company, a company that I have respected for so long. Before this incident, I revered your company for their outstanding warranty plans. I have purchase a laptop from you about 2 years ago and I had planned on purchasing another one from you within the next 2 months. I have even tried to obtain a job with you, to no avail. But now I have to seriously consider who I want to do business with.

Now comes the remedy. All I would like to do is exchange my 20GB 3rd Generation iPod (retail value $399) for a 40GB 4th Generation iPod (retail value $399). I would also like to have the remaining time of my Service Plan transferred to my new iPod. Upon delivery of the 40GB iPod, I will gladly surrender my 20GB 3rd Generation iPod to whomever you elect. If these conditions are unacceptable, please contact me right away, either by phone: {my phone number} or email: {my email address}.

Because of my experience at Best Buy and 1-888-BEST-BUY, I have elected to contact the Better Business Bureau and the Colorado State Attorney Generals office. I hope that this incident is just an isolated case and that it can be remedied as quickly as it occurred. You have a great company and I would hate to have its name and reputation tarnished by this single incident.

A new new iPod

I used some of the money I received for graduation and purchased an iPod last month. Well, this month Apple released the next generation of iPod (G4). It’s $100 bucks cheaper, weighs just 159 grams, and boasts a 12 hour battery life (a 50% increase from G3). Understandably, I was rather pissed. My iPod wasn’t even 2 months old before the next version came out. So I called Best Buy today to see what I could do about the problem. Turns out, since I purchased a replacement plan, I can just bring it in my old iPod and get the new one for free! How cool is that. Now the only question I have is whether I get the 20GB or the 40GB. We’ll see.

Colorado

It seems that some people are unware of the fact that I am in the state of Colorado right now. Well, I am. Now that’s out of the way. Tomorrow we’re heading up to Estes Park to go paintballing. In preparation, I purchased some new supplies including a new face mask, camo jacket, camo gloves, and camo head thing. I’m also going to try and make a ghillie suit at some point.

Re: Road Trip!

The road trip has been vetoed by the parental units. I can’t say I blame them. It would have been a huge undertaking to plan in only a few days. Perhaps sometime else.

Mines moon mission may be NASA’s next

A Colorado School of Mines proposal to collect rocks from the far side of the moon was selected Friday as one of two finalists for a $700 million NASA mission.

The proposed Moonrise mission would send twin robotic spacecraft to execute the first lunar landings since the Apollo program ended in 1972.

Both craft would land in the 1,500-mile-wide South Pole-Aitken Basin. Robotic arms would scrape about 5 pounds of rock and soil into return capsules, which then would head back to Earth.

In January, President Bush outlined a plan to return astronauts to the moon as early as 2015. Robotic missions would pave the way for the manned lunar landings.

“Our mission is consistent with the president’s new vision for exploration,” said Colorado School of Mines geologist Michael Duke, who heads the Moonrise team.

“I think it fits,” he said Friday. “I think we will benefit from the fact that the country’s space program will be focused on the moon for the next few years.”

The South Pole-Aitken Basin soil and rock would be “clearly different from anything we’ve sampled before,” Duke said.

In February, seven proposals were submitted for the next mission in NASA’s New Frontiers program of unmanned solar system exploration flights.

The other finalist announced Friday is Juno, a Jupiter orbiter that would study the giant planet’s atmosphere and magnetic field. The Juno team is headed by Scott Bolton of NASA’s Jet Propulsion Laboratory.

“It was a very tough decision, but we’re excited at the prospect of the discoveries either of them could make,” said NASA Associate Administrator Ed Weiler.

Each of the New Frontiers finalists will receive up to $1.2 million to complete a detailed “implementation feasibility study” in the next seven months. In May 2005, a winner will be named. The selected mission must be ready for launch by June 30, 2010. Costs will be capped at $700 million.

Road Trip!

We drove to Pueblo today to visit my mothers aunt. I think that makes her my great aunt, hmmm. Anyways, we drove through Colorado Springs and picked up my aunt (my mothers younger sister). She’s moving to Virginia and needs help driving out, so I offered to help and now it sound like I might go! ROAD TRIP! I’ve never been east of the Rockies, so this should be very fun and even educational. If this does work out, I hope to have lots of pictures.

In other news, we’re going paint balling on Thursday.

Explore CSM

We drove the entire Seattle-Broomfield, CO trip in just under 24 hours. It was quite a feat of driving. We drove essentially nonstop the entire way. I went to my college orientation today and learned quite a few new things. The day was long and I was really tired when I got back. I’m glad I only have to do this once. I checked out the Greek scene and decided to go Greek and then changed my mind to not go Greek, but to at least check out the Greek thing the first week of school (Rush).
